1. Identification

This document sets out the terms and conditions governing the use of www.sweezywear.com and purchases made through the SweezyWear online store.

By browsing this website or placing an order, users confirm that they have read, understood, and accepted these Terms and Conditions.

SweezyWear is a brand selling clothing, accessories, personalised products, gift cards, and maternity kits, with a focus on comfortable and practical products suitable for babies and mothers.

2. Scope

These Terms and Conditions apply to all users who access the website, browse the online store, or make purchases from SweezyWear.

SweezyWear reserves the right to amend these Terms and Conditions at any time. Changes will be published on this page, and users are advised to review this document regularly.

3. Products

SweezyWear sells clothing and accessories for babies, mothers, and maternity, including garments, accessories, textiles, personalised products, gift cards, and kits.

Product images, descriptions, colours, sizes, and features are presented as accurately as possible. However, minor differences may exist between the images shown and the actual product due to screen settings, lighting, or content updates.

Some products may include specific features such as magnetic fasteners. Users should always consult the product description, instructions for use, washing instructions, and any safety recommendations before use.

4. Products Containing Magnets

Some SweezyWear garments may contain magnetic fasteners designed to make dressing and undressing babies easier.

Although these elements are designed for safety and comfort, users should check the condition of garments regularly. If any damage, wear, loose stitching, or other defect is detected, use should cease immediately and SweezyWear should be contacted.

People with implanted medical devices, such as pacemakers, should take particular care when using garments containing magnets and consult a healthcare professional beforehand if in doubt.

5. Prices

All prices displayed on the website are in euros (€) and include VAT at the applicable legal rate unless otherwise stated.

SweezyWear reserves the right to change prices, campaigns, promotions, and commercial conditions at any time without prior notice. Such changes will not affect orders that have already been confirmed and paid.

In the event of an obvious pricing error, SweezyWear reserves the right to cancel the order, inform the customer, and issue a refund if payment has already been made.

6. Orders

To place an order, users must select the desired products, add them to the cart, and complete the purchase through the website checkout.

When completing an order, customers are responsible for ensuring that all information supplied is correct, including their name, delivery address, telephone number, email address, and billing details.

After the order is completed, the customer will receive an email confirmation containing the purchase details.

7. Product Availability

Orders are subject to product availability. If an ordered product is unavailable, SweezyWear will contact the customer to propose a solution, which may include substitution with another product, issuance of a voucher, waiting for restocking, or a refund.

8. Personalised Products

Personalised products are made according to the specifications provided by the customer.

Customers are responsible for confirming all information, text, names, sizes, colours, and other instructions before completing the order.

Except where there is a defect or an error attributable to SweezyWear, personalised products cannot be returned or exchanged because they are made specifically for the customer.

9. Payment Methods

The available payment methods are displayed during the online-store checkout process.

An order will only be processed after payment has been confirmed. SweezyWear is not responsible for delays arising from failures or pending validations by payment providers.

10. Delivery and Shipping

Orders will be sent to the address provided by the customer at the time of purchase.

The estimated delivery time is 3 to 5 business days, except in exceptional circumstances, stock shortages, periods of high order volume, public holidays, carrier delays, or other causes beyond SweezyWear's control.

Shipping charges are calculated and displayed at checkout before the purchase is completed. Free-shipping promotions may be offered, including for orders above a stated amount, when indicated on the website.

SweezyWear is not responsible for delays caused by incorrect or incomplete delivery information provided by the customer.

11. Right of Withdrawal

Under applicable law, customers have 14 days from receipt of the order to exercise the right of withdrawal without giving a reason, except in cases excluded by law.

To exercise this right, customers must contact SweezyWear at ola@sweezywear.com, quoting the order number and identifying the products they wish to return.

Products must be returned in the same condition in which they were received, without signs of use, washing, damage, odours, alterations, or removed labels, where applicable.

12. Exclusions from the Right of Return

Returns will not be accepted for:

Personalised products or products made to the customer's specifications;
Used, washed, damaged products or products unsuitable for resale;
Products without their original packaging, labels, or accessories, where applicable;
Products that cannot be returned after opening or use for hygiene reasons.

13. Exchanges

SweezyWear may accept exchanges of size, colour, or item, subject to stock availability and provided the product is in perfect condition.

To request an exchange, customers must contact SweezyWear at ola@sweezywear.com, quoting the order number and reason for the exchange.

The customer may be responsible for shipping costs associated with an exchange, except where an error or defect is attributable to SweezyWear.

14. Refunds

After receiving and inspecting returned products, SweezyWear will refund the amount paid for eligible products using the same payment method used for the purchase, unless otherwise agreed.

The refund will be made within the applicable legal period, although processing time may vary depending on the bank or payment method.

SweezyWear reserves the right to refuse a refund if the returned products do not meet the conditions set out in these Terms and Conditions.

15. Defects or Order Errors

If a customer receives a defective product or a product different from the one ordered, they must contact SweezyWear at ola@sweezywear.com, quoting the order number and attaching photographs that allow the matter to be assessed.

Following review, SweezyWear may replace the product, issue a voucher, or provide a refund, as applicable.

16. Gift Cards

Gift cards purchased from the SweezyWear online store may be used as payment for future purchases in accordance with the conditions presented at the time of purchase.

Unless otherwise stated, gift cards cannot be exchanged for cash and are non-refundable after issue.

17. Promotional Codes and Campaigns

SweezyWear may offer promotional codes, discounts, or temporary commercial campaigns.

Promotional codes are personal, non-transferable, and may only be used under the conditions stated in the relevant campaign.

SweezyWear reserves the right to cancel or refuse the use of promotional codes in the event of misuse, technical error, or failure to comply with campaign conditions.

18. Product Care

Customers must always follow the washing, drying, and care instructions shown on the product label or in the description available on the website.

SweezyWear is not responsible for damage resulting from improper use, incorrect washing, unsuitable exposure, use of harsh products, or failure to follow care instructions.

19. User Accounts

Users may create an account on the website to facilitate future purchases, view orders, or manage their details.

Users are responsible for maintaining the confidentiality of their login details and for all activity carried out through their account.

If unauthorised access is suspected, the user must contact SweezyWear immediately.

20. Intellectual Property

All website content, including text, images, photographs, logos, design, graphics, product descriptions, and other visual or written elements, is owned by SweezyWear or used with the authorisation of the relevant rights holders.

Website content may not be copied, reproduced, distributed, altered, or used without SweezyWear's prior written authorisation.

Any use that may damage, overload, compromise security, interfere with the operation of the online store, or harm third parties is prohibited.

25. Limitation of Liability

SweezyWear is not responsible for damage arising from improper use of products, failure to follow care instructions, incorrect information supplied by the customer, temporary technical failures, website interruptions, or delays caused by third parties.

SweezyWear seeks to ensure that all information available on the website is accurate and up to date but does not guarantee the absence of occasional errors, omissions, or failures.

26. Governing Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law.

In the event of a dispute, and without prejudice to mandatory legal provisions applicable to consumers, the competent court will be the court determined under Portuguese law.
